General terms of use of the Tours Hvar website
All prices on the Tours Hvar are retail with VAT included.
Prices and payment terms published on the website www.tourshvar.com apply exclusively to purchases through the Orioly booking system.
The Consumer Protection Act (N.N.41 / 2014), Chapter III applies to business conditions. – Conclusion of off-premises and distance contracts, from Article 57 to Article 79.

Payment options
When Clients makes reservation for private tour/tailor made tour/boat rental, Client pays 30% of total price within 7 days for confirming reservation. The rest of amount 70%, Client pays 30 days before taking the service of private tour/“tailor made“ tour/boat rental in Tourist agency Big Blue tours d.o.o. or U.O. Kormoran.
Important
Cancellation policy
If client does not appear on the departure day of the tour (which had previously paid entirely), and did not announce the arrival (within 24 hours before departure), he/she is not entitled to a refund paid for the tour.
Situations where:
Client books a daytrip/ private tour / rents a boat with skipper cancelled by themself in a following periods:
- up to 30 days before departure Big Blue tours d.o.o. retains 10% of the paid amount, and at least 100 kn
- 29-15 days before departure Big Blue tours d.o.o. retains 25% of the paid amount
- 14-3 days before departure Big Blue tours d.o.o. retains 40% of the paid amount
- 2 -0 days before departure Big Blue tours d.o.o. retains 100% of the paid amount
TOUR CANCELLATION OR CHANGE OF PROGRAMME BY Big Blue tours d.o.o. or U.O. Kormoran
Photo policy
By entering Big Blue tours d.o.o. or U.O. Kormoran speedboat tours and or events, you waive all rights you may have to any claims for payment or royalties in connection with any exhibition, streaming, web-casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such exhibiting, broadcasting, web-casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photograph, video, or audio recording taken by Big Blue tours d.o.o. or U.O. Kormoran or the person or entity designated to do so by the company.
Big Blue tours d.o.o. or U.O. Kormoran reserves the right to use any photograph and/or recording taken on company property or at any event sponsored by the company without the express written permission of those included within the photograph or recording. Big Blue tours d.o.o. may use the photograph and/or recording in publications or other media material produced, used, or contracted by the company, including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc.
Images are strictly prohibited from being reproduced, copied, or altered in any way other than by Big Blue tours d.o.o. or U.O. Kormoran and its official representatives.
If you prefer not to be included in photographs or recordings, please step away from the camera or inform the photographer if you have inadvertently been included. Photographers may honor such requests at their own discretion.
Big Blue tours d.o.o. or U.O. Kormoran is not obligated nor required to remove your voice or likeness from any interview(s), photography, audio recording, video recording, publications, exhibitions, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on web sites, or any other purpose, but will consider removing and may remove any photographs or recordings at the written request of the individual.
General conditions
A.1.) The General Terms and Conditions apply between the client and the agency Big Blue tours d.o.o. (hereinafter: “Agency”), in connection with the ordering of products by the client through the website of the Agency (hereinafter: “tourshvar.com”).
A.2.) Client is any natural person who enters into a legal transaction or operates on the market outside his trade, business, craft or professional activity and who is a visitor to tourshvar.com, and submits an order to the Seller to purchase an individual and / or group of products Agency.
A.3.) All contracts concluded between the Agency and the Client in connection with the purchase of the Agency’s services through tourshvar.com are regulated by the provisions of these General Terms and Conditions, the laws listed in the preamble to the General Terms and Conditions, and the Personal Data Protection Act.
A.4.) These General Terms and Conditions are published on the website tourshvar.com. The client has the option and is authorized to store or print these General Terms and Conditions on their own computer system.
B) INVALIDITY OF OTHER CONTRACTUAL CONDITIONS
B.1.) These General Terms and Conditions apply as the primary and mandatory source of law governing the legal relationship between the Agency and the Client and in this sense have a predominant effect over all other possible sources, and replace all other written or oral contracts, terms and conditions and / or agreements between the Agency and the Client and / or contractual terms of other persons, which deviate from these General Terms and Conditions. In case of disagreement between these General Terms and Conditions and all other agreements between the Agency and the Client, these General Terms and Conditions shall prevail, unless the parties agree otherwise in writing.
C) VALIDITY OF CONSUMER RELATIONS
C.1.) These General Terms and Conditions apply to all persons who are considered Consumers in terms of the legislation of the Republic of Croatia.
D) VALIDITY OF RELATIONSHIP WITH FOREIGN CITIZENS
D.1.) These General Terms and Conditions also apply to persons, whether natural or legal, who have citizenship other than the citizenship of the Republic of Croatia, regardless of any differences in the legal or statutory position of the customer and regardless of his actual ability to understand Croatian. to which these General Terms and Conditions have been drawn up.
D.2.) These General Terms and Conditions apply to stateless persons, as well as to the staff of foreign diplomatic and consular missions and to honorary consuls and consulates of foreign countries on the territory of the Republic of Croatia.
E) ADVERTISING
E.1.) The Agency’s announcements represent a presentation of the basic conditions of sale, unless the Agency explicitly states otherwise.
F) GENERAL INFO ON THE METHOD OF PAYMENT
F.1.) All prices on tourshvar.com are stated in Croatian Kuna (HRK) and Euro (€), unless otherwise explicitly stated. Prices include value added tax (VAT).
F.2.) Tourshvar.com internet system enables users to pay and purchase by credit or debit card, bank transfer, payment in the post office, FINA, internet banking or payment in a bank in accordance with the conditions specified in these General conditions.
G) PAYMENT BY CREDIT OR DEBIT CARDS
G.1.) Payment by credit or debit card is made through a virtual POS system called “WS Pay” protected by Secure Socket Layer (SSL) protocol. Through tourshvar.com, payment is possible with credit and / or debit cards: American Express, MasterCard, Maestro, Diners and Visa. When paying for a product with the customer’s credit or debit cards, the payment service provider will charge the same for the amount of the purchase price and other related costs.
G.2.) After issuing a specific order for payment on the customer’s credit or debit card, the customer waives any right to terminate, cancel and / or change the execution of a specific payment order. Such waiver applies only to the irrevocability of the payment transaction and does not affect the rights of the Customer in connection with the termination of the contract. In this regard, the Customer is responsible for all costs and damages that may be incurred by the Agency in this regard.
G.3.) The customer is responsible for ensuring that he provides the credit or debit card payment service provider with a sufficient amount of money to make the payment of the purchase price and all other applicable costs. This relationship is governed by the rules between the payment service provider and the customer that the right to payment is used by a credit or debit card, and that the customer submits complete and accurate credit or debit card information by order. Otherwise, the Customer is liable for all damages and costs incurred or may be incurred by the Agency in relation to the violation of this obligation of the Customer.
H) OTHER
H.1.) Any contract concluded on the basis of these General Terms and Conditions will be stored in electronic form of the Agency’s system, and the Buyer may access them through the Agency’s services. By confirming acceptance of these General Terms and Conditions, the customer agrees to the collection, processing and storage of the contract and all relevant personal data (name, surname, address, OIB, etc.).
H.2.) The Client or the consumer may submit their requests, complaints, objections, statements, as well as any praise to the Agency in writing to the address: Tours Hvar d.o.o., Kroz Burak 12 Hvarskih Bratovština 15, 21450 Hvar.
H.3.) By accepting these general terms and conditions, the customer confirms that he is familiar with and agrees with the provisions of the General Terms and Conditions, which allows the use of the tourshvar.com system.
H.4.) The customer confirms that he is aware that the current General Terms and Conditions are subject to constant changes and improvements, so for all future purchases he assumes the responsibility to be familiar with the current general terms and conditions applicable to tourshvar.com.
H.5.) Changes to these terms and conditions as well as the provisions of the contracts concluded on the basis of these General Terms and Conditions are possible only on the basis of a written agreement of the contracting parties. Verbal contracts and / or agreements are not permitted.
I) DISPUTE RESOLUTION
In the event of a dispute between a Client and a Agency, an application can be submitted to the Croatian Chamber of Commerce, the Croatian Chamber of Trades and Crafts, a conciliation proposal to the Conciliation Center or the European Commission via the online dispute resolution form. The trader and the consumer will try to resolve any disputes by agreement and amicably, otherwise the Municipal court in Hvar has jurisdiction.
J) NOTICE ON THE MANNER OF WRITTEN COMPLAINT OF THE CONSUMER
All complaints in accordance with Article 10 of the Consumer Protection Act (N.N. 41/2014), you can send by mail, fax or e-mail as well as in the business premises / stores where you are. If the complaint is submitted in business premises / shops, the trader is obliged to immediately certify his receipt in writing.

In order to confirm the receipt of a written complaint in accordance with Article 10, paragraph 5 of the Act, and then respond to it, please provide the exact information for the receipt of the same. We will legally provide you with a written response to your complaint no later than 15 days from the date of receipt of the complaint.
